1. Preamble
Thank you for taking part in the wundermeeting.app beta‑testing programme. During this closed test phase we provide you with early‑access software so that we can collect feedback and improve the service before public launch. These Terms of Use (the “Terms”) form a binding agreement between you (the “Tester” or “you”) and def initialize GmbH, Greifswalder Str 13D, 10405 Berlin, Germany (the “Developer,” “we,” “our”). By clicking “I accept” when the Terms are first displayed in the application, you agree to the following provisions.
2. Scope of Application
These Terms govern your use of all components of the wundermeeting.app service, including the downloadable or installable application, any associated plug‑ins, updates, and the web interface (collectively the “Service”). No separate terms apply to individual delivery channels. Any conflicting or additional terms proposed by you shall not apply.
3. Formation of Contract
The contract is formed when you (i) download or otherwise gain access to the Service and (ii) click the “I accept” button presented with these Terms. We may decline or revoke access at our sole discretion.
4. Beta Tester Program – Service Description
- The Service is experimental and provided free of charge exclusively for testing and evaluation purposes.
- Any use of the beta services in conjunction with actual data and/or in a productive setting, is at your sole risk. These beta services are not generally available and may contain bugs, errors, defects or harmful components.
- Functionality, performance and features may change at any time without notice.
- We do not promise any particular uptime, availability, error‑free operation or fitness for any purpose.
- As consideration for your feedback, you receive the Service gratis.
- TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT ANY WARRANTY, EXPRESS OR IMPLIED.
- You acknowledge that no claims for defects, damages or specific performance may be brought against us arising out of or in connection with the Service being provided as experimental.
- Nothing in these Terms affects any statutory rights you may have as a consumer under mandatory German consumer‑protection law. In the event of a conflict between such mandatory provisions and these Terms, the mandatory provisions shall prevail.
5. Data Security and Processing Responsibility
- When processing personal data, wundermeeting.app acts in accordance with the General Data Protection Regulation (GDPR). Please review our Privacy Policy available in Privacy Policy. Continued use of the Service implies that you have read and understood that policy.
- We apply commercially reasonable best‑effort technical and organisational measures to safeguard data; however, you understand and accept that the beta version, being beta, may not have passed final security audits.
